TERMS OF SERVICE
1. Purpose
These Terms of Service govern access to and use of the THYLY website and its features.
THYLY is operated by Traore Cheibou Barroine, a sole trader. The store uses the Shopify platform to provide website hosting and certain technical features.
Use of the website implies acceptance of these Terms of Service, without prejudice to the consumer's statutory rights.
2. Access to the website
The THYLY website is accessible to anyone with Internet access.
We make reasonable efforts to ensure that the website is available and operates properly. Temporary interruptions may nevertheless occur, including for maintenance, updates or reasons beyond our control.
3. Product information
We make reasonable efforts to present the characteristics, descriptions and photographs of our products as accurately as possible.
Slight differences in colour or display may occur depending on the screen or device used. These differences do not affect the consumer's statutory rights concerning product conformity.
The essential characteristics, price and necessary information concerning each product are presented before the order is confirmed.
4. Orders and sales
Purchases made on THYLY are also subject to our Terms of Sale, Shipping Policy and Return and Refund Policy.
An order may in particular be refused or cancelled in the event that a product is unavailable, payment cannot be processed, there is a reasonable suspicion of fraud, or there is an obvious error concerning essential information in the offer.
Any such decision is made in accordance with applicable law and consumer rights.
5. Prices and payment
The applicable prices are those displayed at the time of the order.
Any delivery charges and other applicable fees are shown to the customer before the order is finally confirmed.
Payments are processed by the payment providers offered on the store.
6. Delivery
The applicable arrangements and timeframes are detailed in our Shipping Policy.
THYLY remains responsible for proper performance of delivery in accordance with applicable legal provisions.
The risk of loss or damage to the product passes to the consumer when the consumer takes physical possession of the goods or when a third party designated by the consumer, other than the carrier, takes possession of them.
Where the consumer independently appoints a carrier other than those offered by THYLY, the specific statutory rules relating to transfer of risk apply.
7. Intellectual property
Texts, graphic elements, logos, photographs, content, creations and other elements making up the THYLY website are protected by applicable intellectual property rules where eligible for protection.
Any unauthorised reproduction, representation, modification or use of these elements is prohibited, except with prior authorisation or where an exception is provided by law.
Trademarks, logos and content belonging to third parties remain the property of their respective owners.
8. Third-party services and links
Certain website features may be provided by Shopify or other third-party service providers.
The website may also contain links to external websites. THYLY does not control the content or practices of these third-party websites. Their use is subject to the terms and policies of their respective operators.
9. Prohibited uses
The website must not be used for unlawful or fraudulent purposes or in any manner likely to infringe the rights of THYLY, its customers or third parties.
In particular, attempts to gain unauthorised access, introduce malicious software, impersonate another person, fraudulently collect data or otherwise interfere with the normal operation of the website are prohibited.
10. Personal data
The processing of personal data in connection with use of the store is described in our Privacy Policy.
Certain data required for operation of the store may also be processed by Shopify and our service providers in accordance with their respective obligations.
11. Liability
THYLY cannot be held liable for damage resulting from use of the website contrary to these Terms or from an external event that could not reasonably be avoided.
Nothing in these Terms is intended to exclude or limit any right or guarantee that the consumer is mandatorily entitled to under applicable law.
12. Governing law
These Terms are governed by French law.
For consumers residing in another country of the European Union, this choice does not deprive them of the mandatory protective provisions to which they are entitled under the law applicable in their country of residence.

In the event of a difficulty, the customer is invited to contact THYLY first in order to seek an amicable solution.

14. Changes to these Terms
These Terms may be updated to reflect changes to the website, our services or applicable legal obligations.
